1) Agreement to Terms
By accessing our website, placing an order, or using our services (the “Services”), you agree to these Terms and to our Privacy Policy, Shipping & Returns, and Warranty & Defect Policy, which are incorporated by reference. If you do not agree, do not use the Services.
2) Eligibility & Accounts
You must be at least 18 (or the age of majority where you live) to purchase. You’re responsible for safeguarding your account credentials and for activity under your account.
3) Changes to These Terms
We may update these Terms from time to time. Changes are effective upon posting, as indicated by the “Last updated” date. Material changes may be highlighted on-site or via email.
4) Products, Content & Availability
We strive for accuracy, but descriptions, images, dimensions, and colors may vary slightly due to 3D printing, glass manufacturing, and display settings. We may discontinue or limit items at any time.
5) Orders, Acceptance & Payment
Your order is an offer to purchase; we accept by shipping the product. We may refuse, limit, or cancel orders (e.g., fraud risk, policy violations, inventory constraints). You authorize our payment processor to charge your selected method for the order total, including taxes and shipping.
6) Right to Refuse Service
We reserve the right to refuse service to anyone for any reason at any time, consistent with applicable law. We do not refuse service on the basis of any legally protected characteristic. We may suspend or terminate access for conduct that violates these Terms or the law.
7) Pricing, Taxes & Errors
Prices are in U.S. dollars unless stated otherwise. We collect applicable sales tax where required. If there’s an error in price or availability, we may cancel or adjust the order after notice.
8) Shipping; Title & Risk of Loss
Shipping options/timelines appear at checkout and in Shipping & Returns. Title and risk of loss pass to you when we deliver items to the carrier, unless applicable law requires otherwise.
9) Made-to-Order & Customization
Most products are made to order. For custom colors, sizing, or branding, production begins after specs are confirmed. Custom orders are non-cancelable and non-returnable except for verified defects covered by our Warranty & Defect Policy.
10) Safety & Proper Use (Important)
Our lamps are designed for indoor, dry locations only. You agree to:
Use only the specified bulb type/base/wattage listed on the product page (E26, LED ≤15 W, 120 V ~ 60 Hz).
We recommend a T32 warm-light LED (2200–2700 K).
Do not use incandescent or halogen bulbs.
Do not exceed rated wattage, do not modify the lamp/cord/socket/switch, and do not use if any component is damaged.
Keep away from flammables, hot surfaces, prolonged direct sun, water, and damp areas.
Unplug before bulb changes or cleaning; keep away from children & pets.
PLA may soften above 130 °F (55 °C); handle with care around heat.
Do not leave the lamp on for more than 4 hours continuously; allow it to cool before handling.
Improper use, non-recommended bulbs, or exceeding wattage may cause overheating, discoloration, or risk of fire/electric shock and voids any warranty.
11) Handcrafted Variation Notice
Each lamp is handmade and 3D-printed; minor surface/texture or color variations (layer lines, gloss differences) are normal and not defects. We inspect each lamp before shipping to ensure it looks and functions as intended.
12) Components, Third-Party Parts & Compliance (UL/ETL)
We use UL/ETL-listed electrical components (e.g., cords, sockets). Unless a product page states otherwise, the assembled lamp is not UL-certified as a whole; references to UL/ETL relate to components only. Some components (e.g., electrical cords, bulbs) are manufactured by third parties and not by Lumina. To the maximum extent permitted by law, we are not responsible for defects in third-party components or for damage arising from misuse, alterations, or incompatible bulbs.
13) Prohibited Uses
You may not misuse the Services, including by violating laws; infringing IP; accessing non-public areas; interfering with security; scraping/harvesting data; or using the Services to develop competing products.
14) Intellectual Property
All designs, 3D models, photos, text, logos, and trademarks are owned by Lumina or our licensors and protected by law. No rights are granted except as necessary to use the Services for their intended purpose.
15) User Content (Reviews, Photos) & DMCA
If you submit reviews, photos, or other content, you grant Lumina a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display that content in connection with the Services and our marketing. You represent you have the necessary rights and your content does not infringe others.
To report copyright infringement, email hello@numiadesign.com with a DMCA-compliant notice (signature; work identified; infringing URL; contact info; good-faith and authority statements).
16) Promotions, Gift Cards & Referrals
Promotions are subject to the offer terms. Unless specified, they can’t be combined, have no cash value, and exclude gift cards and prior purchases. We may reverse credits for abuse or fraud. Gift cards: redeemable for eligible goods, not reloadable or exchangeable for cash (unless required by law); lost cards aren’t replaced.
17) Communications; Email/SMS
By providing your contact info, you consent to transactional messages and—if you opt in—marketing messages. Marketing emails include an unsubscribe link; SMS: reply STOP to opt out, HELP for help. Message/data rates may apply.
18) Privacy; Cookies; Accessibility
Privacy. See our Privacy Policy for how we collect, use, and disclose personal information and your rights.
Cookies & Tracking. We use cookies/pixels for functionality (cart/checkout), analytics, and (where permitted) advertising. Manage non-essential cookies via Cookie Preferences and your browser settings. If your browser sends a Global Privacy Control (GPC) signal, we treat it as an opt-out of sale/sharing/targeted advertising where required by law.
Accessibility. We aim for WCAG 2.1 AA conformance. If you encounter barriers, email hello@numiadesign.comwith the page URL and description; we’ll respond and provide an alternative format upon request.
19) Warranty & Returns (Summaries)
Your purchase is covered by our Warranty & Defect Policy (e.g., limited warranty for lamps/cords; DOA bulbs within 7 days). Returns are governed by Shipping & Returns (e.g., 30-day window, free return when conditions are met). Those policies control if there’s any conflict with this summary.
20) Third-Party Services
Our Services may link to or integrate third parties (payments, analytics, ads, Shopify/Framer apps). We’re not responsible for third-party content or practices. Their terms and privacy policies may apply.
21) Disclaimers
Except as expressly stated in our Warranty & Defect Policy, the Services and products are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
22) Limitation of Liability (Use-Specific)
To the fullest extent permitted by law, Numia Design is not liable for any damage, loss, or injury arising from misuse, manipulation of the electrical cable, alterations, use with non-recommended or over-wattage bulbs, or failure to follow safety instructions. Except to the extent caused by our gross negligence or willful misconduct, and to the extent permitted by law, we are not responsible for any damages caused by the lamp or third-party components. In all cases, our total liability is limited to the purchase price of the product at issue, and we disclaim indirect, incidental, special, and consequential damages.
23) Indemnification
You agree to defend, indemnify, and hold harmless Lumina from claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of the Services or products, or infringement of third-party rights.
24) Force Majeure
We’re not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, war, labor disputes, supply shortages, carrier issues, power or internet interruptions).
25) Governing Law & Venue
These Terms are governed by the laws of the State of New York (without regard to conflict-of-law rules). You agree to the exclusive jurisdiction and venue of the state and federal courts in New York County, New York.
(If you prefer binding arbitration with a class-action waiver, tell us and we’ll substitute this section.)
26) Assignment; Severability; Entire Agreement
You may not assign these Terms without our consent; we may assign to an affiliate or in connection with a merger or asset sale. If any provision is held invalid, the remainder remains in effect. These Terms (plus incorporated policies) are the entire agreement between you and Lumina regarding the Services.
27) B2B / Wholesale Terms (Global)
Scope. Applies to purchases for resale or commercial use (“Wholesale”). Wholesale terms may be supplemented or superseded by a signed sales agreement, line sheet, or invoice; a signed agreement controls in case of conflict.
Quotes & Orders. Quotes valid 30 days unless stated otherwise. Orders are accepted when we issue a written acknowledgement or invoice. MOQs/pack quantities may apply.
Pricing & Payment. Confidential pricing. Standard terms: 50% deposit to start production, 50% prior to shipment (or Net [15/30] with approved credit). Late balances may accrue 1.5%/month (or the maximum allowed). Buyer covers bank/transfer fees.
Lead Times. Begin upon receipt of deposit and final specs; vary with volume, custom colors, and materials availability.
Specs & Custom Work. We produce to Lumina specs unless agreed otherwise. Custom designs/colors require written sample/color approval. Minor cosmetic variations inherent to 3D printing/glass are not defects.
Shipping; Title & Risk. Unless stated otherwise, EXW New York, USA (Incoterms® 2020). Title/risk pass at our dock. Buyer arranges freight/insurance; we can quote DAP/DDP on request. For international shipments, Buyer is importer of record and responsible for customs, duties, taxes, and compliance.
Inspection & Acceptance. Inspect on delivery; notify within 7 days (with photos) of shortages/defects or acceptance is deemed. Remedies: repair, replacement, or credit (our option). No returns without RMA.
Resale & Brand Use. Accurate marketing and legal compliance required. Unless approved in writing: (a) no rebranding or removal of Lumina marks; (b) no sale on third-party marketplaces under our brand; (c) comply with any MAP policy.
Intellectual Property. Lumina retains IP in products/brand. Custom designs by Lumina remain Lumina IP unless a separate signed agreement assigns/licenses IP. No copying, reverse engineering, or derivatives.
Warranty (Wholesale). Mirrors consumer policy unless otherwise specified. Remedies limited to repair, replacement, or credit at invoice price; no consequential damages.
Cancellations. Orders are firm once acknowledged. Custom/made-to-order items are non-cancelable and non-returnable. Stock order cancellations require our consent and may incur restocking fees.
Compliance & Ethics. Each party complies with export controls/sanctions, anti-corruption (U.S. FCPA/U.K. Bribery Act), and labor/environmental laws.
Governing Law & Venue. New York law; courts in New York County, New York (unless a separate agreement specifies arbitration).
Language. English version controls if translated.
